Elderly woman injured in British Columbia car accident

An elderly woman is clinging to life in a hospital after she was struck by a car in East Vancouver the night of Sept. 29. British Columbia authorities have reported she was walking in a crosswalk when the car accident occurred. For the moment, police have not filed charges against the driver, but this does not preclude the woman, or someone designated to act on her behalf, from filing a personal injury lawsuit. 

According to a police spokesman, the 73-year-old woman was crossing the street in the crosswalk, but may have been walking slowly. As a result, she was unable to make it all the way across the street in time. Around 9:40 p.m., a vehicle crossed through the crosswalk on the green light and struck the woman. She was rushed to a local hospital with injuries described as potentially life-threatening. 

The 69-year-old driver who hit her remained at the scene and cooperated with police. Authorities do not believe speed or alcohol were factors in this crash. As a result, it is difficult to say whether they will choose to file criminal charges against the driver. 

Even if they do not, however, the woman still has legal options available to her. British Columbia law recognizes the need for pedestrians to be vigilant when crossing the road, even when they have the right of way. However, drivers are also required to maintain an awareness of their surroundings when operating a vehicle, particularly in areas where pedestrian traffic is high. In civil court, a case for negligence on the part of the driver in this car accident may be appropriate.
