Car accident in British Columbia seriously injures cyclist

A West Vancouver man is in critical condition following a serious crash involving an SUV, local police have reported. The 76-year-old man was struck in an intersection on Aug. 10 and is still in the hospital as of this report. So far, British Columbia police have issued tickets to the driver they believe to be responsible for the car accident, but they have not yet filed criminal charges against him. 

The accident report says the cyclist was headed through an intersection when he was forced to swerve into oncoming traffic to avoid a pickup truck pulling a trailer. The SUV was reportedly attempting to make a left-hand turn incorrectly. As a result, the cyclist was struck by the SUV. He was rushed to hospital around noon and remains there in critical condition. 

The SUV driver, who remained on the scene and cooperated with police, was not charged with an infraction. However, the pickup truck driver left the scene of the accident and was, therefore, cited with two tickets: failure to remain at the scene of an accident and driving without due care and attention. It is unknown whether the man will face further charges as the police investigation continues. 

Even if British Columbia authorities choose not to file further criminal charges against the driver responsible for the car accident, the injured man still has legal recourse available to him. Provincial law will allow him to file a personal injury lawsuit against the driver. Such a suit is considered civil in nature and is not dependent upon a criminal conviction or even criminal charges to be successful in court.
